VEXAR Bin Collections

These Terms & Conditions apply to VEXAR Bin Collection services. By subscribing to a VEXAR Bin Collection service, you agree to these terms.
1. THE SERVICE
VEXAR provides scheduled general waste collection services to eligible residential and commercial properties. Customers may select from the collection plans currently offered by VEXAR. Fortnightly Collection — £29.99 per month Collection of one allocated 240L VEXAR bin every two weeks. Weekly Collection — £54.99 per month Collection of one allocated 240L VEXAR bin every week. Subscriptions operate on a rolling monthly basis with no minimum contractual term unless otherwise expressly agreed. Prices applicable to a customer will be clearly displayed before the customer subscribes.
2. SERVICE AREA AND ELIGIBILITY
Bin Collection services are available only within areas currently served by VEXAR. Acceptance of a subscription is subject to the property being suitable for the service and reasonably accessible for bin delivery and collection. VEXAR may decline or cancel a subscription where a property cannot reasonably or safely be serviced.
3. VEXAR BIN
A 240L VEXAR wheelie bin will be allocated to the customer’s property for use while the subscription remains active. The bin remains the property of VEXAR at all times. Payment of the subscription does not transfer ownership of the bin to the customer. The customer must not sell, dispose of, permanently alter, remove VEXAR branding from, or move the bin permanently to another property without VEXAR’s permission.
4. BIN DELIVERY
Following signup, VEXAR will arrange delivery of the allocated bin to the service address. Customers may provide reasonable delivery instructions during signup. Delivery dates may depend on route scheduling, stock availability and operational circumstances.
5. COLLECTION SCHEDULE
VEXAR assigns collection days according to its operating routes. Weekly customers will normally receive one scheduled collection each week. Fortnightly customers will normally receive one scheduled collection every two weeks. VEXAR may change collection days or route schedules where reasonably necessary. Where practicable, customers will be given reasonable notice of changes to their normal collection arrangements. Bank holidays, operational requirements and other circumstances may result in temporary changes to collection dates.
6. PRESENTING THE BIN FOR COLLECTION
The customer is responsible for ensuring that the VEXAR bin is: • presented at the front of the property on the scheduled collection day; • readily accessible to the collection team; • positioned somewhere that can be approached and moved safely; and • ready for collection at the required collection time. VEXAR is not required to enter buildings, rear gardens, locked areas or otherwise search a property for a bin that has not been correctly presented. If a bin is not presented or cannot reasonably be accessed when VEXAR attends, VEXAR is not required to make a separate return journey. The next collection will normally take place on the customer’s next scheduled collection day. No refund, credit or carry-forward collection will normally be provided where a collection is missed because the bin was not correctly presented or accessible.
7. ACCEPTED WASTE
The Bin Collection service is intended for ordinary bagged general waste suitable for disposal through the VEXAR general waste collection service. Waste placed inside the bin should be securely bagged. The bin must not be used as a substitute for a waste-removal or clearance service.
8. PROHIBITED AND UNSUITABLE WASTE
Customers must not place prohibited, hazardous or unsuitable material in a VEXAR bin. This includes, but is not limited to: soil, rubble, bricks, concrete, plasterboard, liquids, paint and chemicals, gas cylinders, batteries, electrical items, hot ash, clinical or infectious waste, hazardous waste, and excessively heavy or otherwise unsafe materials. VEXAR may refuse to empty a bin containing prohibited or unsuitable waste. The customer must remove the offending material before a future collection. Waste that falls outside the Bin Collection service may be suitable for collection through VEXAR Waste Removals, subject to a separate estimate and service arrangement.
9. OVERFILLED OR EXCESSIVELY HEAVY BINS
The bin lid should close properly. Bins must not be loaded to a weight that prevents them from being safely moved or emptied using normal collection procedures. Waste must not be compacted, jammed or positioned in a manner that prevents the contents from emptying normally. VEXAR may refuse to empty a bin where doing so would be unsafe, risk damaging equipment or property, or otherwise fall outside reasonable collection procedures. Where the problem results from how the customer has used or loaded the bin, no refund or credit will normally be due.
10. ADDITIONAL BLACK BAGS
Existing VEXAR Bin Collection customers may purchase collection of additional black bags of accepted general waste alongside their normal scheduled bin collection. Additional bags currently cost £3 per bag and must be booked and paid for in advance through the VEXAR booking facility. Bookings must normally be completed by 6:00pm on the day before the scheduled collection. Paid additional bags should be securely tied and presented alongside the customer’s VEXAR bin. There is currently no fixed numerical limit on additional prepaid bags. Collection remains subject to reasonable vehicle capacity, safety and operational availability. Where the quantity of waste is unsuitable for collection as part of the scheduled route, VEXAR may contact the customer to arrange an alternative solution. Furniture, loose waste, bulky items, builders’ waste, garden waste and other material that is not ordinary bagged general waste is not eligible for the £3 additional-bag service and should instead be arranged through VEXAR Waste Removals where appropriate. Additional bags that have not been booked and paid for in advance may be left uncollected.
11. MISSED COLLECTIONS CAUSED BY VEXAR
Where VEXAR fails to collect a correctly presented and eligible bin because of an operational error within VEXAR’s control, the customer should contact VEXAR. VEXAR will aim to arrange a replacement collection as soon as reasonably practicable.
12. EVENTS OUTSIDE VEXAR’S REASONABLE CONTROL
Collections may occasionally be delayed, changed or prevented by circumstances outside VEXAR’s reasonable control, including severe weather, unsafe road conditions, road closures, vehicle breakdowns, access restrictions or other significant operational disruption. Where this happens, VEXAR will take reasonable steps to resume or rearrange the affected service as soon as reasonably practicable and will provide information to affected customers where appropriate.
13. SUBSCRIPTION PAYMENTS
Subscription charges are payable monthly in advance using the payment method offered during signup. Online subscriptions may be processed through Stripe or another payment provider made available by VEXAR. Payment providers process payment information in accordance with their own terms and privacy practices. VEXAR does not require customers to make cash payments to collection crews for normal subscription collections.
14. FAILED PAYMENTS
Where a subscription payment fails or becomes overdue, VEXAR may temporarily suspend collections while payment remains outstanding. The payment provider may attempt to collect the outstanding payment again in accordance with its own processes. If payment remains outstanding for 14 days, VEXAR may terminate the subscription and arrange recovery of the VEXAR bin. Payment of outstanding amounts does not automatically entitle a customer to replacement collections for collections suspended during a period of non-payment.
15. CANCELLING THE ROLLING SUBSCRIPTION
Subject to applicable statutory cancellation rights, customers may cancel their rolling monthly subscription before the next renewal date. No further monthly subscription charge will then be taken. Unless otherwise agreed, service will continue until the end of the period already paid for. Unused scheduled collections are not refundable and do not carry forward merely because the customer did not require or use a collection during the paid service period. At the end of the service, VEXAR will arrange recovery of its bin. There is no routine cancellation or bin-recovery fee for a customer who cancels normally and makes the VEXAR bin available for recovery.
16. CONSUMER CANCELLATION RIGHTS
Where a customer is legally classed as a consumer and enters into the contract online or otherwise at a distance, statutory cancellation rights may apply. Consumers will generally have 14 days to cancel a service contract entered into at a distance, subject to applicable law. Where a consumer requests that VEXAR begins providing the service during the statutory cancellation period and subsequently exercises a statutory right to cancel, the customer may be required to pay a proportionate amount for services already supplied where permitted by law. Nothing in these Terms & Conditions is intended to restrict or exclude a customer’s statutory rights.
17. BIN RECOVERY FOLLOWING CANCELLATION
When a subscription ends, the customer must make the VEXAR bin reasonably accessible for recovery. The customer must not deliberately retain, dispose of or prevent VEXAR from recovering its bin. Where repeated attempts to recover the bin are prevented by the customer, or where the bin has been lost or disposed of through misuse or negligence, VEXAR may seek the reasonable cost of recovery or replacement.
18. DAMAGE, LOSS AND THEFT
VEXAR is responsible for normal wear and tear arising from ordinary use of its bins. Customers are expected to take reasonable care of the allocated bin. Where a bin is deliberately damaged, misused, lost through negligence or disposed of without permission, VEXAR may charge the reasonable cost of repair or replacement. Customers should notify VEXAR promptly if a bin is stolen. Theft will be considered according to the circumstances and will not automatically be treated as customer negligence.
19. BIN CLEANLINESS AND HYGIENE
Customers are responsible for keeping the allocated bin in a reasonably clean and hygienic condition while it is at their property. Waste should be appropriately bagged and the bin lid kept closed where practicable. VEXAR’s standard subscription does not include a bin-washing service. VEXAR is not responsible for odours, insects, pests or similar hygiene issues resulting from waste stored in the bin between scheduled collections, except where VEXAR has failed to exercise reasonable care in providing the service.
20. MOVING PROPERTY
Customers must tell VEXAR if they are moving from the registered service address. A VEXAR bin must not simply be taken to a new property without approval. Where the new address is within a VEXAR service area and can reasonably be serviced, VEXAR may transfer the subscription to the new address. Where the new property cannot be serviced, the subscription can be brought to an end and VEXAR will arrange recovery of its bin.
21. MULTIPLE BINS AND SHARED PROPERTIES
Unless otherwise agreed, each subscription covers the number of VEXAR bins expressly included in the customer’s selected plan. Additional bins or arrangements for shared, managed, multi-occupancy or commercial properties may require a separate subscription or tailored service arrangement.
22. PRICE CHANGES
VEXAR may change subscription prices from time to time. Existing customers will normally receive at least 30 days’ notice before a subscription price increase takes effect. Where an existing customer does not wish to continue at the new price, they may cancel before the new price becomes applicable.
23. CHANGES TO THE SERVICE OR THESE TERMS
VEXAR may make reasonable changes to its service, routes, operating procedures or these terms where necessary. Routine operational changes, such as temporary collection-day adjustments, may be made with reasonable notice where practicable. Where a material change is likely to significantly disadvantage an existing customer, VEXAR will provide reasonable advance notice and, where appropriate, an opportunity to cancel before the change takes effect.
24. SAFETY, MISUSE AND CUSTOMER CONDUCT
VEXAR may refuse, suspend or terminate service where reasonably necessary because of: • threatening, abusive or violent behaviour towards VEXAR personnel; • unsafe access or conditions at the property; • repeated misuse of VEXAR equipment; • repeated presentation of prohibited or dangerous waste; • suspected illegal use of the service; or • other serious or repeated breaches of these terms. Where appropriate and reasonably practicable, VEXAR will give the customer an opportunity to remedy a breach before terminating the service. Nothing requires VEXAR personnel to carry out work they reasonably consider unsafe or unlawful.
25. OUR RESPONSIBILITY TO CUSTOMERS
VEXAR will provide its services with reasonable care and skill. Nothing in these terms excludes or restricts liability where doing so would be unlawful or limits a consumer’s statutory rights. VEXAR will not be responsible for losses resulting from a customer’s failure to comply with these terms, or for events outside VEXAR’s reasonable control, except where applicable law provides otherwise.

27. PRIVACY
VEXAR processes personal information required to administer subscriptions, deliver and collect bins, process payments, communicate with customers and operate its services. Full information about how personal data is collected, used, shared and retained is provided in the VEXAR Privacy Policy.
28. GOVERNING LAW
These terms are governed by the laws of England and Wales. Nothing in this provision removes any mandatory rights a consumer may have regarding the courts or jurisdiction in which they are entitled to bring proceedings.
